Book Summary:

As challenges to land use and environmental controls by landowners and the property-rights movement have become more frequent, the concept of "takings" -- government action that excessively limits a property-owner's use of private land -- has become both increasingly familiar to the public, and increasingly problematic for planners, local officials, and anyone involved with making day-to-day decisions about land use. A vast and diverse body of case law has come into existence over the past several decades, and the controversy generated by recent legal decisions has resulted in a significant level of ideological bias in much of what has been written on the topic. This volume is an objective and authoritative examination that considers all aspects of the takings issue. It is a much-needed guide and overview that introduces and explains issues surrounding regulatory takings on the local, state, and federal level for anyone involved with private land and government limitation of its permissible use. The authors describe where the law is now, predict where it might go in the future, and review conflict-reducing solutions to a variety of situations. They condense an immense amount of information into a clear and accesible format, making the book equally valuable for lawyers and non-lawyers alike. The Takings Issue addresses procedural hurdles involved in getting a takings issue heard by a court, examines what does and does not constitute a taking, and considers the remedies available to landowners involved in takings actions. It treats concerns such as zoning, dedications and exactions, subdivision platting, and other local issues in some detail, and also considers state and federal issues involving industrial site approval, endangered species and wetlands protection, restrictions on access to resources on federal lands, and other topics. The book is an essential reference for planners, land use lawyers, developers, and students of planning and law, as well as for policymakers and citizens involved with takings issues.

Book Summary:

Proposition 13 reduced the ability of local gov't's. to finance public goods and infrastructure through local taxes. Local gov't's. responded by increasing their reliance on fees and exactions. The constitutional takings clause may represent yet another limitation on the ability of local gov't's. to finance public improvements. In addition, CA's burgeoning population and scenic and natural resources make it fertile ground for the conflicts associated with growth: how should transportation infrastructure and other public services be financed as communities spread outward? How should open space, habitat, and access to recreational resources be preserved and paid for? Tables.

Book Summary:

This report helps planners and attorneys understand takings jurisprudence in light of the U.S. Supreme Court's 1987 trio of important land-use decisions. It summarizes and analyzes each of the cases and comments on its specific relevance of planners. The authors also pose a series of questions that can be used, in conjuction with real estate evaluation techniques, to determine whether a taking has occurred. The report continues with two case studies that utilize the rulings and techniques discussed in the preceeding two sections. The report also explains why administrative hearings are an essential part of the zoning and land-use review process.

Book Summary:

Ideology in the Supreme Court is the first book to analyze the process by which the ideological stances of U.S. Supreme Court justices translate into the positions they take on the issues that the Court addresses. Eminent Supreme Court scholar Lawrence Baum argues that the links between ideology and issues are not simply a matter of reasoning logically from general premises. Rather, they reflect the development of shared understandings among political elites, including Supreme Court justices. And broad values about matters such as equality are not the only source of these understandings. Another potentially important source is the justices' attitudes about social or political groups, such as the business community and the Republican and Democratic parties. The book probes these sources by analyzing three issues on which the relative positions of liberal and conservative justices changed between 1910 and 2013: freedom of expression, criminal justice, and government "takings" of property. Analyzing the Court's decisions and other developments during that period, Baum finds that the values underlying liberalism and conservatism help to explain these changes, but that justices' attitudes toward social and political groups also played a powerful role. Providing a new perspective on how ideology functions in Supreme Court decision making, Ideology in the Supreme Court has important implications for how we think about the Court and its justices.

Book Summary:

If legal scholar Richard Epstein is right, then the New Deal is wrong, if not unconstitutional. Epstein develops a coherent normative theory that permits us to distinguish between permissible takings for public use and impermissible ones. He then examines a wide range of government regulations and taxes under a single comprehensive theory.

Book Summary:

What do economists know about land-and how they know? The Oxford Handbook of Land Economics describes the latest developments in the fields of economics that examine land, including natural resource economics, environmental economics, regional science, and urban economics. The handbook argues, first, that land is a theme that integrates these fields and second, that productive integration increasingly occurs not just within economics but also across disciplines. Greater recognition and integration stimulates cross-fertilization among the fields of land economics research. By providing a comprehensive survey of land-related work in several economics fields, this handbook provides the basic tools needed for economists to redefine the scope and focus of their work to better incorporate the contemporary thinking from other fields and to push out the frontiers of land economics. The first section presents recent advances in the analysis of major drivers of land use change, focusing on economic development and various land-use markets. The second section presents economic research on the environmental and socio-economic impacts of land use and land use change. The third section addresses six cutting-edge approaches for land economics research, including spatial econometric, simulation, and experimental methods. The section also includes a synthetic chapter critically reviewing methodological advances. The fourth section covers policy issues. Four chapters disentangle the economics of land conservation and preservation, while three chapters examine the economic analysis of the legal institutions of land use. These chapters focus on law and economic problems of permissible government control of land in the U.S. context.

Book Summary:

Following a comprehensive overview by the editors, this volume s expert contributors provide detailed discussion of important legal, ecological and social issues associated with coastal resource management, as well as the most significant challenges confronting land use planners and resource managers in coastal communities. Using an interdisciplinary approach to perplexing questions surrounding the issue of development versus protection, the volume presents a broad approach to coastal issues involving private rights and public trust. Part I: The Law and Coastal Environments provides background information on the more recent federal and state lawsuits, statutes and regulations that impact coastal environments. In Part II: Ecological Consequences for Coastal Development, scientists discuss threats posed by elevated nitrogen levels and heavy metal contamination in coastal waters, followed by descriptions of the impact of development on habitats essential to estuarine-dependent fish and migratory shorebirds. In Part III: Private Use, Public Trust and Coastal Protection the authors explore ways to balance private use of the coast with public rights of access and preservation. They discuss the concept of stewardship by both public and private landowners, factors affecting environmental values in coastal communities, and facilitation of enlightened public policies for growth management and resource protection. Appropriate for courses pertaining to coastal ecology, coastal management or land-use planning, this book will also appeal to a diverse audience of economists, concerned citizens, environmental lawyers and policymakers.
