This report examines the Crown Estate Commissioner's management of the Crown property, rights and interests which make up the Crown Estate in Scotland. The Commissioner's operations in Scotland can be split into two categories: ancient possessions/responsibilities and modern activities relating to the buying, selling and management of property and land. The evidence identified major issues, particularly in relation to the seabed and the foreshore: including lack of accountability, lack of communication and consultation with local communities, the inappropriateness of the Commissioner's remit for its responsibilities in the marine environment, the cash leakage from local economies and other adverse impacts. There were no such problems in relation to the management of urban and rural estate. The Commissioner's responsibilities for the seabed, the foreshore and other ancient rights in Scotland should be devolved then decentralized as far as possible. Devolution to Holyrood should be conditional upon agreement between the Secretary of State for Scotland and the Scottish Government on how such a scheme of subsidiarity to local authority and local community levels should be implemented. This report also sets out how different arrangements could be made for each of the Scottish Crown property rights and responsibilities. Further consultation should proceed on the basis of proposals set out by the Highlands and Islands local authorities, which provides a clear framework on which to base discussion.

Two years ago, the Committee recommended that these Crown property rights and interests, which are not the personal property of the Monarch but are held in trust for the nation, should be decentralised as far as possible. The Committee states that they are even more convinced that decentralisation is essential if local communities are to benefit from the development of these assets. The Committee remains convinced that the transfer of these assets from an over-centralised London to an over-centralising Edinburgh would not be sufficient, and that local people and local authorities should be given primacy in determining how these assets should be developed and how financial benefits should be distributed.

At the heart of the Government's proposals are the provisions to give the Scottish Parliament the powers to raise a single rate of Scottish income tax, and to reduce the block grant accordingly. The committee says it is a major omission that neither the Bill nor the Command Paper provides an adequate explanation as to how the balance between income tax and the reduction to the block grant will be calculated. The Government should have put forward a considered proposal on the principles and methodology of this system, and detailed consideration should be given, as a matter of urgency, to how the reduction in the block grant will be calculated. Provisions in the Bill for both capital and revenue borrowing powers are to be welcomed, but the committee notes the concern of witnesses that the limits are too low. It recommends that the Government, in close consultation with the Scottish Parliament and with the committee, reconsiders the proposed limits, and it suggests as a starting point for discussion the amount of £1bn, with a limit of £500 million in any one year.The report also highlights the committee's intention to continue its scrutiny role as the proposals are implemented. In particular, it intends to closely monitor the roles of the UK Government, HMRC and the Office for Budget Responsibility.

The Government should look again at how Remploy agreed this contract on such generous terms for the client. This business has considerable potential and should be supported accordingly. This high quality manufacturing base in Fife must be maintained otherwise it is likely that it - and the design and expertise developed here - will be transferred overseas. A "one size fits all" approach does not take account of the unique circumstances and potential of Remploy Marine Fife. One of the central criteria by which bids for the Remploy sites will be judged is sustaining the workforce in employment. The Committee rejects the DWP and Remploy's unyielding, inflexible approach and failure to offer adequate transitional support
